2. The petitioner is apprehending arrest in connection with Araria P.S. Case No. 280/2024 registered on 15.05.2024 for the offences punishable under Sections of the Indian Penal Code.

3. As per the prosecution, the FIR has been lodged against unknown accused persons against whom there is an allegation that the accused persons got the motorcycle of the informant stopped and snatched two mobile phones from the informant. It is also alleged that the accused persons snatched ATM cards and cash amounts from the informant.

4. It is submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no offence. He

No.61385 of 2024(2) dt.11-09-2024 2/2 further submits that the antecedent of the petitioner is clean and his name has figured in this case by virtue of the confessional statement of the co-accused. Moreover, no incriminating article has been recovered from his possession and the petitioner has not been put on the Test Identification Parade.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In the facts and circumstances, let the above-named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of 6 weeks from today, on furnishing bail bond of 30000/- (thirty thousand) ₹ with two sureties of the like amount each to the satisfaction of the learned CJM, Araria, in connection with Araria P.S. Case No. 280/2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
