JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-08-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Town P.S. Case no. 523 of 2016, registered under Sections 147, 148, 149, 342, 447, 384, 385, 379, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
The allegation of informant Bablu Kumar is that Dr. Sidharath Narayan Agrawal purchased the land and handed over to the informant for looking after and constructing boundary through agreement dated 15.06.2016 for which the informant paid Rs. 3000/- per annum. On 28.07.2016, Dr. Sidharath Narayan Agrawal instructed the informant to construct the boundary wall, then informant started construing boundary wall in the meantime, five persons named in the
Patna High Court Cr.Misc. No.25307 of 2017 (4) dt.19-08-2017 2/2 F.I.R. including the petitioners came there armed with pistol and forbade to construct the boundary wall unless paid of Rs. 5 lakhs as rangadari. On protest, Sachidanand snatched golden chain of 12 gram worth of Rs. 36000/-.
Learned counsel for the petitioners submits that, in fact, sister of the petitioner No.2 filed Tile Suit No. 596 of 2014 against the petitioners and other family members for partition of the land, including the land as detailed in the F.I.R. in which Dr. Sidharath Narayan Agrawal also filed an application to implead him as necessary party, which was allowed on 10.12.2016 only to give undue pressure Dr. Sidharath Narayan Agrawal managed to lodge the present case with false allegation of demand of ransom of Rs. Five lakhs for construction of the boundary wall.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Town P.S. Case No. 523 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
