Mr.Shantanu Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 30-09-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 420/302/201/120B of the Indian Penal Code.

Initially a police case was lodged of the occurrence and after investigation the police did not sent up the petitioner for trial, thereafter, on protest petition the complaint case started. According to the statement of the complainant on oath the accused persons got a deed of gift from Gharbharani Devi and thereafter committed her murder.

Patna High Court CR. MISC. No.60132 of 2019(2) dt.30-09-2019 2/2 Submission is that deceased was aged about 70 years and she died a natural death, just to pressurize false case has been lodged.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Complaint Case No.862(C) of 2014, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
