1. Heard learned counsel for the parties concerned.

The petitioner has filed this application alleging deliberate and willful defiance of the order, dated 12.10.2023, passed by this Court in CWJC No. 9629 of 2021, whereby, the direction was given to the Vice Chancellor, Magadh University, to dispose the representation of the petitioner regarding non-payment of salary since December, 2018, on its own merit and in accordance with law within a period of three months from

From perusal of the show-cause, filed on behalf of the Magadh University, it appears that the petitioner filed a representation before the Vice Chancellor, Magadh University, on 31.10.2023 and the Vice Chancellor disposed the representation of the petitioner by a reasoned order, dated 21.02.2024, bearing Ref No09/MU/Legal/24, annexed at Annexure-R/A, stating therein, that the petitioner concealed the fact that he has already been working as Government Teacher since 2013, nevertheless, he joined as Assistant Professor in the B.Ed. programme under the self financing scheme at Gaya College, Gaya, simultaneously, and has been withdrawing salary arbitrarily. The Three-man Committee, constituted by the Vice-chancellor, found the allegations true and genuine against the petitioner.

It has further been stated that the petitioner had also produced false medical certificate in support of his unethical and ulawful medical leave for the period from 17th November, 2018 to 11th March, 2019, due to which an FIR, bearing Kotwali Police Station Case No. 538 of 2018, dated 16.11.2018, has been lodged.

4. Considering the aforesaid, this contempt application stands dismissed.
