JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 448, 341, 323, 307, 379, 354 and 504/34 of the Indian Penal Code.

Heard learned counsel for the petitioners.

It has been submitted on behalf of the petitioners that the main allegation is against Kailash Mukhiya and so far as petitioners are concerned, it is alleged that they have assaulted the daughter of the informant but there is only one injury found on the daughter of the informant and that is simple in nature. The petitioners and the informant are heirs of common ancestor and only for family dispute they have been implicated in the case. Heard learned A.P.P. also.

Having heard both sides, in view of the fact stated

Patna High Court Cr.Misc. No.381 of 2017 (2) dt.17-01-2017 2/2 above, let above named petitioners, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sursand P.S. Case no. 174 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure on condition that they will co-operate in the investigation and they will appear before the police as and when required. .
