Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 27(b) (ii)/27d/28 of the Drug and Cosmetic Act, 1940 and 27d of the Drug and Cosmetic Act, 1945.

It has been submitted on behalf of the petitioner that allegation against the petitioner is that he was selling the medicines without having license. The petitioner is an RMP doctor and as such he was keeping the drugs for his personal use and for the using of his patients. It has further been submitted that the petitioner has no criminal antecedent and he is ready to abide by any conditions.

Patna High Court Cr.Misc. No.54567 of 2016 (2) dt.13-01-2017 2/2 Heard learned Additional Public Prosecutor also. Considering the fact aforesaid and submission of the learned counsel for the petitioner and the fact that the petitioner is an RMP doctor, the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Purnea, in connection with Dagaruwa P.S. Case No. 114/2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with further condition that he will co-operate in the investigation of the case and he will make himself available before the police as and when required.
