JUSTICE BIRENDRA KUMAR ORAL JUDGMENT Date: 09-05-2017 Father of the petitioner lodged Farbisganj P.S. Case No.320 of 2016 for the offence under Sections 366 and 120B I.P.C. read with Section 34 I.P.C. for alleged kidnapping of the petitioner. The petitioner has filed the present writ application for issuance of direction to the respondent nos.1 to 5 for giving police protection to the petitioner to facilitate her to get her statement under Section 164 Cr.P.C. recorded as she feels danger at the hands of respondent nos. 6 to 8.

Patna High Court Cr. WJC No.1295 of 2016 dt.09-05-2017 Learned counsel for the State respondents submits that the petitioner never filed any petition for police help to the respondent authorities, otherwise the petitioner would have been provided with such protection.

The Superintendent of Police, Araria is directed to give police protection to the petitioner to carry her from her residence to the court premise for getting her statement recorded under Section 164 Cr.P.C. on a convenient date fixed by the petitioner. The petitioner is also at liberty to file a representation before the Superintendent of Police, Araria along with a copy of this order giving her present address and phone number to facilitate aforesaid protection.

With the aforesaid observation, this writ application stands disposed of.
