JUSTICE SATYAVRAT VERMA ORAL ORDER 01-08-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is alleged to be an order giver on which it is alleged that Rahul and Kaushal assaulted the injured with bricks and wounded the informant. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, even the police after investigation has not found the case to be true

Patna High Court CR. MISC. No.70630 of 2021(3) dt.01-08-2022 2/2 against the petitioner. Learned counsel next submits that there is a case and counter case between the parties and the present occurrence took place on account of land dispute. Learned A.P.P. for the State and the learned counsel for the informant vehemently oppose the prayer for anticipatory bail of the petitioner. Learned counsel for the informant very fairly concedes that police during the course of investigation has found no material against the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Chiksaura P.S. Case No. 74 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
