1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner seeks regular bail in connection with Darauli Police Station Case No. 127 of 2019, dated 05.08.2019, registered for the offence punishable under Sections 341/323/ 307/427/379/504/506/34 of the Indian Penal Code.

3. The prosecution case, as per First Information Report, is that petitioner, along with other accused persons, assaulted the informant and his son and also took away some jewellery and cash of Rs. 50,000/-.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to village politics. He further submits that

No.63562 of 2024(2) dt.20-09-2024 2/2 the petitioner and the informant are neighbours and the petitioner has lodged Darauli Police Station Case No. 80 of 2018 against the informant and others for allegedly kidnapping the grand daughter of the petitioner by the son of the informant. He further submits that there is general and omnibus allegation against the petitioner and the petitioner is aged about 70 years. He next submits that petitioner is in custody since 04.07.2024.

5. Regards being had to the submissions made by the parties and taking into consideration the materials available on record and the fact that petitioner, aged about 70 years, is in custody since 04.07.2024, I am inclined to grant regular bail to the petitioner.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Darauli Police Station Case No. 127 of 2019.
