The petitioner apprehends his arrest in Tajpur P.S. Case No. 232 of 2017 registered for the offences punishable under Sections 483 and 486 of the Indian Penal Code, under Sections 63 and 65 of the Copy Right Act, 1957 and under Sections 103 and 104 of the Trade Mark Act, 1999.
The informant alleged that he got information that the petitioner was selling duplicate Bayer Regant and on such the police raided the shop of the petitioner. From the shop of the petitioner duplicate Regant G.R. of Bayer company was recovered.
Learned counsel for the petitioner submits that the petitioner purchased pesticides from the Paste Control Centre,
Patna High Court Cr.Misc. No.48985 of 2017 (2) dt.18-10-2017 Jamal Road, Patna and the petitioner could not be able to verify the original from its duplicate as only some spelling is different. In the original product Bayer was written, while in the duplicate Buyer was written.
Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Samastipur in Tajpur P.S. Case No. 232 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) KKSINHA/- U T
