It is submitted by learned counsel for the petitioners that relying upon the decision of this Court in the case of Harendra Mishra & Others -Versus- State of Bihar & Others in the proceedings arising out of CWJC No 384 of 2017, petitioners have staked their claim before the respondentauthorities by Annexure 5 series to the supplementary affidavit. Since such claim has been raised before the authorities, no useful purpose would be served by keeping this instant proceeding pending as the entitlement of rehabilitation of the petitioners is to be decided by the authorities themselves having regard to the decision rendered by this Court in the proceedings arising out of CWJC No 384 of 2017. Respondents No 2 to 4, therefore, should take a final decision in respect of the petitioner's claim, as raised by Annexure 5 series to the supplementary affidavit within a period of three months from the date of receipt/production of a copy of this order.
