2. The petitioner has invoked the writ jurisdiction of this Court for a direction to the respondents to trace out the kidnapped son of the petitioner. Further prayer is to get the case investigated by some other agency such as C.I.D. or C.B.I.
3. For the occurrence of kidnapping of the son of the petitioner, the father of the petitioner had lodged Rohtas (Amjhor) P.S. Case No. 135 of 2015 registered under Sections 363, 365 and 364A of the Indian Penal Code vide Annexure-1 against unknown.
4. According to FIR, Naveen Kumar, aged about 15 years left the house on 23.10.2015 on a cycle to go to the market but did not return in spite of hectic search. Naveen was not traced out then
Patna High Court Cr. WJC No.6 of 2017 dt.25-07-2017 2/2 FIR was lodged against unknown.
5. During investigation, on the basis of location of the referred mobile, two persons were apprehended and they stated before the police that in fact they had committed murder of the victim for ransom. The police have, accordingly, submitted charge-sheet against those accused persons as stated in the counter affidavit of the Staterespondent. The police have kept the investigation pending for conclusion whether it is a case of murder or not.
6. Nothing has been brought on the record that any bias or unfairness was adopted by the investigating agency, hence, there is no need for a direction to get the case investigated by some other agency.
7. Accordingly, the writ application is being dismissed as devoid of any merit.
