06-11-2018 Heard Mr. Purushottam Jha, learned counsel representing the petitioners in the present case and Ms. Binita Singh learned Advocate for the Lalit Narayan Mithila University, Darbhanga.
This contempt application has been preferred alleging willful disobedience and disregard shown by the opposite parties/contemnors to the order dated 13.11.2013 passed in MJC No. 1043/2012 and analogous cases. By the order of which violation has been complained of, the learned Single Judge had been pleased to
Patna High Court MJC No.4980 of 2014 (5) dt.06-11-2018 clarify certain issues after first holding that the order passed in the writ petition had in fact been substantially complied with. By further clarifications the learned Single Judge had been pleased to direct that all arrears up to date would be paid within four months.
At this stage, in the show cause filed on behalf of the opposite party no. 3 & 4 a statement has been made to the effect that the grievance of the petitioners for the salary arrears has been duly redressed. It is pointed out that a sum of Rs. 16,36,958/- has been paid to petitioner no. 1 as salary arrears for the period 01.03.1989 to 31.03.2017 and after all calculations and verifications a claim of Rs. 72,63,123/- was found payable, out of which an amount of Rs. 56,24,075/- has been duly paid earlier and the balance amount of Rs. 16,36,948/- was pending for payment which has also been paid by transferring the same to the account of the college through RTGS. In this regard, specific statement has been made with regard to all the petitioners in paragraph nos. 5, 6, 7 and 8 with proof of the payment made to them. The Annexures also disclosed in detail the particulars of payment made to these petitioners.

Patna High Court MJC No.4980 of 2014 (5) dt.06-11-2018 still trying to explain to this court about certain discrepancies in the calculations.
This court is of the considered opinion at this stage that in the given facts and circumstances this contempt application is not required to proceed as the order of the court has been complied with, but keeping in mind the submissions of Mr. Jha, it is left open for the petitioners to point out the discrepancies in the matter of calculation of their dues, if any, to the Registrar, Lalit Narayan Mithila University, Darbhanga within a period of 30 days from today and on such discrepancies being pointed out by him, he may look into the matter and dispose of the same within a period of 30 days thereafter.
This application stands disposed off, accordingly.
