NILU AGRAWAL ORAL ORDER 03-01-2019 Heard learned counsel for the petitioner and learned counsel for the Uttar Bihar Gramin Bank, Kalambagh Chowk, Muzaffarpur (here-in-after referred to as, 'the Bank'). Petitioner in the present writ application prays for post retiral benefit, who retired on 31.01.2016 from the post of Officer, Scale-II in the Bank.
It has been submitted by the counsel for the Uttar Bihar Gramin Bank that the petitioner was dismissed from bank service by order, dated 20th April, 2016, which is at Annexure P/4 to the writ application, and, as such, no retiral benefit is admissible to the petitioner. He, further, submits that against the dismissal order, the petitioner has moved this Court in writ application, which is pending adjudication.
Patna High Court CWJC No.19891 of 2016(2) dt.03-01-2019 2/2 Considering the said fact, the present writ application is dismissed, as being premature.
However, the petitioner has moved this Court against the dismissal order in C.W.J.C. No. 1221 of 2017 and C.W.J.C. No. 7074 of 2017. If any favourable order is passed in the said writ application, the petitioner is at liberty to move this Court with the fresh writ application regarding his retiral benefits.
