The petitioner seeks bail in connection with Asanwa P.S. Case No. 13 of 2024 instituted for the offence under Sections 413, 414, 420, 467, 468, 471/34 of the Indian Penal Code. Earlier vide order dated 10-07-2024, passed in Cr. Misc. No. 34260 of 2024, anticipatory bail application of the petitioner was rejected.

Prosecution case in short is that police on the basis of secret information that some miscreants are indulged in sale and purchase of stolen motorcycles, conducted raid and arrested four accused persons including this petitioner. On the basis of disclosure by accused persons, twelve motorcycles is said to

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23-07-2024. Petitioner is a man of clean antecedent.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel submits that it is alleged that twelve motorcycles have been recovered from the bathan of the petitioner, but the bathan does not belong to the petitioner and the motorcycle in question belongs to the customer as the petitioner is mechanic. There is no compliance of Section 100 of the Cr.P.C. Charge sheet has been submitted in this case. Other co-accused have been granted bail by this Court vide orders dated 26-04-2024 and 28-06-2024, passed in Cr. Misc. No. 32105 of 2024 and Cr. Misc. No. 46199 of 2024. 6.
Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.
Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, clean antecedent of the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

No.61099 of 2024(3) dt.27-09-2024 3/3 framing of charge, if not already framed, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Asanwa P.S.
