JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 05-11-2015 Heard Mr. Bakshi S.R.P.Sinha, Sr. Advocate, for the petitioner and Mr. Anil Kumar Singh no.1 APP for the State. Petitioner apprehends his arrest in connection with Ara (Mufassil) P.S. case no. 148 of 2014, registered under Sections 447, 341,323,504, 506, 307 and 379/34 of the IPC. On trivial issue, it is alleged that the petitioner along with others came to the place of occurrence whereafter scuffle took place and the petitioner gave iron rod blow on the head of the father of the informant. Some other persons were also assaulted.

Contention of the petitioner is that there is no repetition of blow. The injury sustained by the father of the informant is simple in nature. Counsel for the State has opposed

Considering the allegation and the citus of the injury I am not inclined to extend the privilege of anticipatory bail to the petitioner. Let the petitioner surrender and pray for regular bail before the learned Court below. In case the same is preferred, the Court below shall consider the same on its own merit uninfluenced in any manner by the present order. The application is disposed of.
