The petitioner is apprehending his arrest in connection with Kharagpur P.S. Case No. 97 of 2012 registered for the offence punishable under Sections 395 and 397 of the Indian Penal Code.

Accusation is of loot of Mobile and Rs. 8600/-. 4.

Learned counsel for the petitioner has submitted that the petitioner has not been named in the F.I.R. rather the F.I.R. has been lodged against unknown persons. On the confessional statement of co-accused Bimal Kumar Singh, who has already been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 2360 of 2013, the name of this petitioner has surfaced in this case. The petitioner has got clean antecedent.

Considering the facts and circumstances of the case and the nature of allegation made against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of S.D.J.M., Munger in connection with Kharagpur P.S. Case No. 97 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
