The petitioner apprehends his arrest in connection with Complaint Case No. 864C of 2014, registered under Sections 406, 420, 504 and 120B of the Indian Penal Code.
Learned counsel for the petitioner submits that on the prayer of learned counsel for the petitioner and the opposite party no. 1, the matter was referred to the Mediation Centre, Patna High Court, vide order dated 23.12.2016, where petitioner and the opposite party no. 2 settled their dispute entering into an agreement as annexed with the report of mediator of mediation
Patna High Court Cr.Misc. No.54222 of 2016 (4) dt.18-07-2017 centre. Accordingly, petitioner will pay Rs.15,000/- through Bank Draft at the interval of two months to the complainant-opposite party no. 2 and further petitioner will pay Rs.2,00,000/- within one year. The opposite party no. 2 has no objection to allow the prayer of anticipatory bail of the petitioner.
Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Complaint Case No. 864C of 2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
