The petitioner apprehends his arrest in connection with Minapur P.S. Case No.243 of 2015 registered under Sections 409 and 420 of the Indian Penal Code.

The accusation is that the petitioner being the Proprietor of Ganpati Rice Mills took 3400 quintals paddy for preparation of rice and to supply 2278 quintals rice to the FCI but the petitioner supplied only 1890 quintals rice to the FCI and caused damaged to Rs.9,61,681.28/- to the FCI due to non supply of 388 quintals rice.

Patna High Court Cr.Misc. No.50528 of 2015 (3) dt.07-12-2015 2/2 Learned counsel appearing on behalf of the petitioner submits that the petitioner has deposited Rs.9,61,683.00/- to the FCI regarding which certificate has been issued by the District Manager, Bihar State Food and Civil Supplies Corporation Limited dated 09.10.2015, which would appear from Annexure- '3' to this application.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender within four weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Minapur P.S. Case No.243 of 2015, subject to the conditions laid down under Section 438(2) Cr. P.C.
