The petitioners being the father, brothers and brother's wife of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The prosecution case is of killing the daughter of the informant after 16-17 years of the marriage for not giving money for the construction of the house. It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.49711 of 2015 (2) dt.05-11-2015 2/2 petitioners that the accusation is omnibus and general and actually the informant is not the eye witness to the occurrence. As per own admission of the informant he came to know about the death of his daughter on 10.04.2015 and went to the in-laws house of his daughter but the FIR was registered on 17.08.2015. Considering the suspicious nature of accusation and lodging of the FIR with inordinate delay, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Nabinagar P.S. Case No. 116 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
