2. In this case, the petitioner is seeking regular bail in connection with Mithanpura P.S. Case No. 419 of 2023, registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

3. As per allegation, there is direct allegation of theft of motorcycle and the recovery of the same from the possession of the petitioner.

4. The learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The recovery as alleged has not been made from the possession of the petitioner. The petitioner has one criminal antecedent and he is in custody since 20.09.2023.

5. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Court No.6, Muzaffarpur (East) in connection with Mithanpura P.S. Case No. 419 of 2023, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
