2. The petitioner has preferred this application for grant of regular bail in connection with Harsidhi P.S. Case No. 311 of 2025, dated 24.05.2025 registered for the offences punishable under Sections 115(2), 117(2), 126, 109, 76, 303(2), 351 and 352 read with Section 3(5) of the BNS.
3. As per the prosecution case, the informant had earlier lodged a case against the accused Ramesh Thakur vide Harsidhi P.S. Case No. 579 of 2024 for theft of electricity and due to lodging of that case, the informant and her husband were assaulted by the petitioner and other co-accused persons. It is further alleged that on 20.05.2025 at about 06:30 PM, the

No.59763 of 2025(2) dt.01-09-2025 2/3 petitioner along with five other unknown miscreants, who were armed with lathi, danda and iron-rod, assaulted the informant and her family members. It is further alleged that the petitioner with an intention to kill inflicted iron-rod blow on the husband of the informant, who received fracture injury on his hand and accused Shankar Thakur inflicted lathi blow to the informant due to which she fell on the ground. The petitioner tried to outrage the modesty of the informant and also snatched her mangalsutra.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The alleged occurrence took place on 20.05.2025, but the FIR has been lodged on 24.05.2025 after a delay of four days without giving any explanation for the said delay. Injury report of the injured persons suggest that all the injuries were simple in nature, except the injury no. 1 inflicted on the husband of the informant, which was found to be grievous in nature, however, the said injury is on non-vital part of the body. The similarly situated co-accused person namely, Shankar Thakur has been granted bail by this Court vide order dated 20.08.2025 passed in Cr. Misc. No. 57017 of 2025. The petitioner carries one criminal antecedent as stated in paragraph no. 3 of the bail
Patna High Court CR. MISC. No.59763 of 2025(2) dt.01-09-2025 3/3 petition. The petitioner is in custody since 25.05.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as petitioner's period of custody, the petitioner, above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Motihari, East Champaran, in connection with Harsidhi P.S. Case No. 311 of 2025.
7. The application stands allowed.
