Petitioners apprehend their arrest in Complaint Case No.29-C of 2017 instituted for the offence under Section(s) 364, 120-B/34 Indian Penal Code.
Counsel for the petitioners has submitted that instant case is counter blast of Bhadaur P.S. Case No.05 of 2017 lodged by the petitionerno.1 against the nephew of the informant, Vinay, for kidnapping the daughter of the petitioner no.1, Pooja Kumari, aged about 15 years. In that case, family member of the nephew of the informant along with nephew are accused. In the instant case, allegation has been made that
Patna High Court Cr.Misc. No.44840 of 2017 (4) dt.22-02-2018 2/3 these petitioners have kidnapped the nephew of the informant, namely-Vinay Kumar.
Learned counsel for the petitioners has enclosed the statement of the victim of Bhadaur P.S. Case No.05 of 2017 recorded under Section 164 Cr. P C., wherein, the victim girl has taken the name of nephew of the informant in her kidnapping. In the facts and circumstances of the case, prayer of the petitioners for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Complaint Case No.29-C of 2017, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Munsifcum-Judicial Magistrate, 1st class, Barh, Patna, subject to the conditions as laid down under Section 438(2) Cr. P. C.
Patna High Court Cr.Misc. No.44840 of 2017 (4) dt.22-02-2018 3/3 in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
