1. Heard learned counsel for the petitioner, learned APP for the State and the learned counsel appearing on behalf of the informant.

2. The petitioner seeks bail in anticipation of his arrest in Fatuha P. S. Case No.191 of 2024 registered for the offences punishable under Sections 341, 323, 307, 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The learned counsel appearing on behalf of the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that the occurrence took place on account of

It is next submitted that specific allegation of assaulting the deceased by an iron rod causing injury on head is against Ranjeet Kumar, as far as this petitioner is concerned, he is also alleged to have assaulted along with other accused persons when the injured fell. It is thus submitted that there is no specific allegation of assault against this petitioner.

The learned A.P.P. as well as learned counsel for the informant opposes the anticipatory bail and submits that no doubt, specific allegation of assaulting the injured leading to death is against Ranjeet, but then, there is specific allegation against petitioner and others of assaulting the injured when he fell on account of assault made by Ranjeet. It is next submitted that from perusal of the post mortem report, it would manifest that the injured suffered four external injuries which amply demonstrates that Ranjeet was not alone in assaulting the petitioner.

5. Considering the submissions made by the learned A.P.P. as well as the learned counsel appearing on behalf of the informant, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.

6. The prayer of the petitioner for anticipatory bail stands rejected.
