====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 21-08-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners seek bail in a case registered under Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2022.
3. As per the prosecution case, 215.400 litres of illicit liquor and one motorcycle were recovered from the bamboo kiln near south of the house of co-accused Golu Kumar. Co-accused Golu Kumar was apprehended on spot who disclosed the name of this petitioner and other co-accused persons.
4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this
Patna High Court CR. MISC. No.56834 of 2025(2) dt.21-08-2025 2/2 case only on the basis of confessional statement of co-accused Golu Kumar. Further submission is that petitioners have no concern either with the seized illicit liquor & motorcycle or with the place of occurrence. Petitioners have one criminal antecedent in which they are on bail. Petitioners are in custody since 23.07.2025 and there is no chance of their absconding or tampering with the evidence. Petitioners undertake to cooperate in the trial.
5. Learned A.P.P. for the State opposes the prayer for regular bail.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (Excise)-II, Kaimur at Bhabua in connection with Bhagwanpur P.S.
