JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 341, 323, 324, 307, 380, 504 of the Indian Penal Code.

The prosecution case is that on 31.07.2015 at 11:00 P.M in the night the informant was sitting at his door when accused persons came variously armed when it is alleged that petitioner No. 1 Md. Jamshed inflicted injury with sword to the informant on his head and when family members of the informant came to rescue then they were assaulted by eighteen accused persons. It is also alleged that accused persons took away household articles and jewellary from the house of the informant.

No.54582 of 2015 (2) dt.02-12-2015 2/2 It is submitted by learned counsel for the petitioners that time of occurrence is 31.07.2015 at 11:00 P.M in the night when the injured have been examined at 10:30 P.M on 31.07.2015. It is further submitted that all the injured have received simple injuries. There is counter version of the occurrence also and petitioners' side also received injuries. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Jaley P.S. Case No. 124 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
