The petitioners are in custody since 19.06.2019 in connection with Baikunthpur P.S. Case No.150/2019 for the offence punishable under Sections 413,414,34 of the IPC. Learned counsel for the petitioners submit that petitioners have been apprehended on mere suspicion and the petitioners are mechanics who have been repairing motorcycle of some police personnel and it is only when the demand for their just the remuneration for the work done by them was that the present petitioners have been roped. It is further submitted that save and except one other case the petitioners having no criminal antecedent. Considering the aforementioned facts and circumstances of the case and that the petitioners have been implicated on the basis of suspicion that they were planning to

Patna High Court CR. MISC. No.57870 of 2019(2) dt.19-09-2019 2/2 sale stolen motorcycle, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gopalganj in connection with Baikunthpur P.S. Case No.150/2019, subject to following conditions:

(1) One of the bailors will be his own blood relative, preferably, father, mother, brother, sister and/or his wife.

(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.

(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.

(4) The petitioner shall co-operate with the investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail.
