2. The petitioners apprehend their arrest in a case registered for the offence under Sections 448, 341, 342, 307, 384, 323, 427, 379, 34 of the Indian Penal Code.

3. As per the prosecution case, petitioners alongwith one unknown person entered in the shop of informant's brother and looted away cash of Rs. 40,000/- and thereafter, assaulted him, due to which, he became unconscious. It is further alleged that petitioners also threw brother of informant into the river, but a fisherman saved his life.

4. It is submitted on behalf of petitioners that petitioners have been falsely implicated in this case. As a matter of fact, a hot talk took place between the parties on the point of cash taken by the informant from the petitioners, resulting in

Patna High Court CR. MISC. No.62629 of 2023(2) dt.11-10-2023 2/2 lodging of this false case. There is no eye-witness to the alleged occurrence. There is general and omnibus allegation. Petitioner no. 1 has got clean antecedent, however; petitioner no. 2 has one criminal antecedent, in which, he is on bail.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VIII, East Champaran at Motihari in connection with Pakaridayal P.S. Case No. 60 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
