JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 29-03-2016 Heard the learned counsel for the petitioner and the learned A.P.P. representing the State.

The petitioner wants to renew his prayer of bail which was earlier rejected vide order dated 21.08.2015 passed in Criminal Miscellaneous No. 32766 of 2015, on the ground that the petitioner is suffering in custody since 18.07.2014 and up till now two prosecution witnesses have been examined out of 16 charge-sheeted witnesses. In near future, trial is not likely to be concluded, to which the learned APP opposes the prayer of bail by submitting that the petitioner gave Dabiya blow on the head of Phuleshwar Singh resulting he died. In the facts and circumstances stated above, finding

Patna High Court Cr.Misc. No.615 of 2016 (4) dt.29-03-2016 2/2 no good ground for reconsideration of prayer of bail, again, the prayer for bail of the petitioner stands rejected in connection with Beldaur P.S. Case No. 81 of 2014 pending in the court of learned Sessions Jude, Khagariya.

However, considering the detention of the petitioner, the trial court is directed to expedite the trial and to conclude the same preferably within six months. (Jitendra Mohan Sharma, J) ajaypd./- U T
