The petitioner seeks bail in Sasaram (M) case No. 816 of 2016 under Section 384, 387, 414, 120B of the Indian Penal Code, under different Sections of the Arms Act as well as under different Sections of Explosive Substance Act. From the house of petitioner 1500 pieces of electronic detonators were recovered.
Sri Buxi S.R.P. Sinha, the learned senior counsel for the petitioner, submits that, of course, petitioner is member of CPI ML (New Democratic) but the house stands in the sister-in-law (Bhabhi) of the petitioner but from perusal of the records, it appears that petitioner has got criminal antecedent and he is
Patna High Court Cr.Misc. No.55563 of 2016 (6) dt.17-04-2017 2/2 accused in as many as nine cases.
It is submitted that in one of the cases the petitioner has already been acquitted.
Considering the facts that 1500 pieces of electronic detonator were recovered and the petitioner has got criminal antecedent, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected at this stage. The petitioner may renew his prayer for bail after remaining one year in custody.
