1. Heard learned counsel for the petitioner and learned counsel for the State.

2. The petitioner apprehends his arrest in connection with Araria (R.S.) P.S. Case No. 367 of 2023 registered under Section 30(a) of Bihar Excise Act.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to suspicion. Further submission is that from perusal of the seizure list, it would be evident that the alleged recovery has been made from the shop of co-accused Md. Imran. The petitioner has got no criminal antecedent.

4. Having considered the facts and circumstances of the

No.60538 of 2023(2) dt.16-10-2023 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Exclusive Special Judge Excise-I, Araria in connection with Araria (R.S.) P.S. Case No. 367 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
