Mr.Brajendra Nath Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 05-10-2024 Heard Mr. Rajnish Chandra, learned counsel for the petitioners and Mr. B. N. Pandey, learned AP.P. for the State.

2. The petitioners apprehend their arrest in connection with Halsi P.S. Case No. 155/ 2024 dated 23.05.2024 registered for the offence(s) punishable under Section(s) 147, 149, 341, 323, 307, 354, 379, 504 and 506 of the Indian Penal Code.

3. The main submissions advanced by learned counsel for the petitioners are that the petitioners have got no criminal antecedent and they have been falsely implicated in this case due to village politics. It is further submitted that the petitioners are preparing for competitive examinations and in order to ruin their career they have been made accused in this case. It is also submitted that there is general and omnibus allegation against

4. Mr. B. N. Pandey, learned APP appearing for the State has opposed the bail prayer of the petitioners.

5. Considering the facts and circumstances of this case as well as the above submissions and mainly the nature of injuries of the informant and informant's aunt, who are said to have sustained injuries in the said occurrence, which are not corroborating the manner of occurrence and also coupled with fair and clean antecedents of the petitioners, this court is inclined to accept the anticipatory bail prayer of the petitioners. Accordingly, let the petitioners named-above, in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Halsi P.S. Case No. 155/ 2024 on furnishing bail bond of Rs. 20,000/-(Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
