JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-01-2017 Heard learned counsel for the petitioners and learned counsel representing the State.

Petitioners apprehend their arrest in connection with Banka P.S. Case No. 793 of 2016 registered for the offence punishable under Sections 366A/34 of the Indian Penal Code. The petitioners are named in the first information report but during investigation the statement of the victim girl has been recorded under Section 164 Cr.P.C. wherein she has not stated the name of the petitioners and has denied regarding her kidnapping. She has stated her age as 19 years and the learned Magistrate has also assessed her age as 18 years. In the facts and circumstances stated above, the petitioners named above, in case of their surrender or arrest within four weeks

Patna High Court Cr.Misc. No.1576 of 2017 (2) dt.17-01-2017 from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 793 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
