The petitioners apprehend their arrest in Dehri P.S. Case No.474 of 2016 instituted for the offence under Section(s) 147, 148, 337, 353, 379, 411 Indian Penal Code, Sections 4(1)(a), 21(1) DE Act, 40(1) BM Act and 33, 41 and 42 of the Forest Act. As per the prosecution story, on 16.09.2016 at about 6.00 AM, on the order of superior Officers, the informant along with raiding party arrived at Gopi Bigha Crusher Mandi where several crusher machines were found in running condition. Stuff materials were also found in huge quantity after crushing the stone chips. The crusher owners had fled away on arrival of the raiding party. Three persons were arrested by the raiding party, who disclosed their name as Sheo Kumar, Chandradeep Singh and
Patna High Court Cr.Misc. No.58 of 2017 (2) dt.11-01-2017 2/2 Vijay Singh (not the petitioners). Three motorcycles and several articles were seized and seizure list was prepared. The informant further alleged that with the help of JCB Machines seventy two crushers were demolished. The arrested persons disclosed the name of twenty one persons, who were running the crusher machines, which included the name of the petitioners at serial no.9, 10, 11 of page 3 of the written report. In this manner, the names of these petitioners have been disclosed by the persons, who have been arrested by the police. As per the written report, the petitioners were not found present at the place of occurrence.
In the circumstances, it is ordered that in the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Dehri P.S. Case No.474 of 2016, they shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Dehri, Rohtas, subject to the conditions as laid down under Section 438(2) Cr. P. C.
