Petitioner apprehends arrest in registered for the offences punishable under Section 420/467 and other allied sections of the Indian Penal Code.

As per the prosecution case, petitioner being branch manager of South Bihar Gramin Bank, Bariswan, Bhojpur from 15.12.2015 to 19.7.2019, committed defalcation of Rs. 2.35 crore from the different accounts holders, i.e, KCCC account, Jivika accounts by opening loan account without obtaining any security and by making forged signatures on the vouchers. Learned counsel for the petitioner submits that the FIR has been lodged by the informant on the instruction of higher officials of the bank without deep verification and

Patna High Court CR. MISC. No.68939 of 2021(3) dt.13-07-2022 2/2 enquiry. No amount has been transferred to the account f the petitioner. It is stated in paragraph 3 of the bail petition that the petitioner has got clean antecedent.

Learned counsel for the State opposes the prayer for bail submitting that there is specific allegation against the petitioner that he misappropriated huge amount of public money. Witnesses during investigation have also supported the prosecution case.

Considering the specific allegation against the petitioner, his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice. (Prabhat Kumar Singh, J) shashi/- U T
