The petitioner seeks bail in connection with Bihpur P. S. Case No. 280 of 2013 registered under Section 394 of the Indian Penal Code.
Regard being had to the fact that on completion of investigation charge-sheet was submitted under Section 395 of the Indian Penal Code and in the police report submitted under Section 173(2) of the Code of Criminal Procedure, 1973 the petitioner has been shown as an absconder as also the fact that he is an accused in at least two more cases of serious nature, I am not inclined to grant him bail for the present even though
Patna High Court Cr.Misc. No.52224 of 2015 (4) dt.01-02-2016 2/2 co-accused persons have been granted bail. Accordingly, the application for bail is rejected.
The prosecution is directed to produce its witnesses before the trial Court expeditiously. In case, the trial is not concluded within one year from the date of framing of charge, the petitioner would be at liberty to renew his prayer for bail before the Court below itself and in that circumstance the trial Court must assign reason as to why the trial could not be concluded within the stipulated period while disposing of the bail application.
