JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with JhaJha P.S. Case No. 105 of 2016, registered under Section 364(A) of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In the course of investigation, one Raju Yadav was apprehended by the Police in connection with JhaJha P.S. Case No. 122 of 2016, who confessed his guilt having hand in the offence of the present case and he also disclosed the name of the petitioner as his associate. Except the confessional statement of co-accused Raju Yadav, there is nothing against the petitioner to show his involvement in the present case.

In the statement recorded under

Patna High Court Cr.Misc. No.54495 of 2016 (3) dt.27-01-2017 2/2 Section 161 Cr.P.C. as detailed in para 21 of victim he has not disclosed the name of this petitioner. The petitioner is in custody in the present case since 20.09.2016 on remanding from JhaJha P.S. Case No. 122 of 2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Jamui in connection with JhaJha P.S. Case No. 105 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
