Mr.Nityanand ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per prosecution case, 900 litres of county made liqour has been recovered from Bolero car.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner is neither driver nor owner of the car in question. No incriminating material has been recovered from the conscious possession of the petitioner. Name of the petitioner has been transpired in the confessional statement of the apprehended co-accused. Petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances, let

No.59946 of 2022(2) dt.09-12-2022 2/2 the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Judge-02, Siwan in Muffasil (Dhanauti O.P.) P. S. Case No. 522 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
