2. The petitioners apprehend their arrest in connection with Dhoraiya P.S. Case No. 27 of 2024 registered under Sections 147, 149, 341, 323, 332, 353, 505 and 120-B of the Indian Penal Code.

3. As per prosecution case, allegation against these petitioners is that they along with other accused persons instigated the mob near Ahiro Mandir and also spread rumours, and when police personnel tried to pacify the matter, the accused persons entangled with them.

4. Learned counsel appearing on behalf of the petitioners

Patna High Court CR. MISC. No.61620 of 2024(2) dt.12-09-2024 2/2 submits that petitioners are innocent and have falsely been implicated in the present case. Further submission is that petitioners were not present at the time of occurrence. Allegation against the petitioners are general and omnibus. No specific over act is alleged against these petitioners. Petitioner no.1 has got clean antecedent. Petitioner no. 2 has got one criminal antecedent, in which he is on bail.

5. Learned A.P.P. appearing on behalf of the State opposed the bail application.

6. Having considered the aforesaid facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail-bonds of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Banka in connection with Dhoraiya P.S. Case No. 27 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
