JUSTICE SUDHIR SINGH ORAL ORDER 09-02-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Vaishali P.S. Case No.235 of 2015 for the offences instituted under Sections 147, 148, 149, 341, 323, 324, 447, 448, 379, 354, 504 and 307 of the Indian Penal Code and section 3(x) SC/ST Act.

The prosecution story, in brief, is that the informant gave a fard-beyan before the police stating that all the named accused persons along with 10-15 unknown persons came at the toddy shop of informant and told Dusad, Chamar Sala and demanded toddy when the informant told that the toddy is not

Patna High Court Cr.Misc. No.50123 of 2015 (4) dt.09-02-2016 2/3 available, on which Niranjan Singh assaulted with iron rod and his head causing cut injury. Bipin Kumar also assaulted the informant's son Abhishek Kumar Nirala with iron rod. Thereafter they entered into his house and Vikky Kumar assaulted with iron rod on the head of the informant's wife and snatched golden chain from her neck.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioners have falsely been implicated in the present case. It is a case and counter case between the parties. For a petty reason, there is difference between the parties. Matter has already been settled and a petition has also been filed in the court below vide Annexure-3. On behalf of the State, it is submitted that the petitioners are not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Vaishali P.S. Case No.235 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of
