The petitioner has renewed his prayer for grant of regular bail in a case registered under sections 272, 273 and 120B of the Indian Penal Code and sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, the petitioner was arrested at the spot and 649.125 litres of liquor was recovered from his Bolero vehicle.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 26.4.2022 (Annexure-1) passed in Cr. Misc. no. 66075 of 2021 giving liberty to the petitioner to renew his

Patna High Court CR. MISC. No.59301 of 2022(2) dt.09-11-2022 2/2 prayer for bail on completing one year in custody. The petitioner is in custody since 1.10.2021.

Having heard learned counsel for the parties and taking into consideration the liberty granted by the aforesaid order dated 26.4.2022 together with the petitioner having remained in custody for over 1 year, the petitioner is directed to be enlarged on bail in connection with Benipatti P.S. Case no. 217 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge - cum - Special Judge, Excise Act, Madhubani.
