JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-08-2017 The petitioner is apprehending his arrest in connection with Sakara P.S. Case No. 202 of 2016, registered for offences punishable under Sections 366(A)/34 of Indian Penal Code. Allegation against the petitioner and other three accused persons is of kidnapping the minor grand daughter of the informant.

It has been submitted on behalf of the petitioner that he has no specific role to play in the said offence rather he was only one of the associates of the main accused of this case and there was love affair between the girl and one of the accused of this case. It has also been submitted that now the matter has been settled between the parties.

Heard learned A.P.P. also.

No.36530 of 2017 (2) dt.11-08-2017 Having heard both sides, considering the facts and circumstances of the case, nature of allegation, I am not inclined to grant the privilege of anticipatory bail to the petitioner, let petitioner surrender before the court below and make prayer for regular bail and if any such application is filed the court below after considering the submission of learned counsel for the petitioner and also that the matter has now been compromised between the parties, shall pass an appropriate order, if possible on same day, without being prejudiced by the order of this Court. With the above observation, this application is disposed of.
