JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-11-2022 Though the present writ petition was filed for removing the encroachment made over plot appertaining to Khesra No. 776 (New)/ 351 (Old) i.e. road situated in Mauza Ghorsar within Kusheshwar Asthan Prakhand, however, the respondent-State has filed a counter affidavit, wherein, it has been stated that the entire encroachment, in question has been removed but the learned counsel for the petitioner has submitted that only part portion of the encroachment has been removed, hence, in such view of the matter, liberty is sought for on behalf of the petitioner to approach the Circle Officer, Kusheshwar Asthan, District-Darbhanga, for taking necessary action against the encroachers. Liberty so sought is granted.

Patna High Court CWJC No.20400 of 2018(4) dt.09-11-2022 2/2 It is needless to state that in case appropriate petition is filed before the Circle Officer, Kusheshwar Asthan, DistrictDarbhanga, within a period of two weeks from today, appropriate action shall be taken by the Circle Officer, concerned, in accordance with law and after hearing the affected parties, within a period of 12 weeks, thereafter. The writ petition stands disposed off.
