The petitioner seeks bail in National Highway (Bangara) P.S. Case No. 02 of 2013 registered under section 392 of the Indian Penal Code.

The first information report is against unknown. Learned counsel for the petitioner submits that the petitioner was apprehended on 21.03.2014 but nothing has been recovered from the possession of the petitioner and name of the petitioner figured in the case in confessional statement of coaccused. The petitioner has not been put on T.I.P. and co-accused Ramchandra Roy has already been enlarged on bail. It appears that except the confessional statement of co-accused the I.O. did not collect any tangible evidence to show the involvement of the petitioner and the petitioner was not even put on T.I.P. and he is in

Patna High Court Cr.Misc. No.41967 of 2014 (3) dt.06-02-2015 2/2 jail since 21.03.2014.

Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Shri Atul Kumar Singh, Judicial Magistrate, Ist Class, Samastipur in National Highway (Bangra) P.S. Case No.02 of 2013.
