2. The present application seeks restoration of Cr. Misc. No. 40380 of 2014, which was dismissed on 28.04.2015, due to non appearance of learned counsel for the petitioner.

3. Learned counsel for the petitioner submitted that the counsel who was initially appearing in the case neither appeared nor informed the petitioner with regard to the development and later on, upon coming to know of the same, the present application has been filed.

4. Having considered the matter, the order dated 28.04.2015 stands recalled and Cr. Misc. No. 40380 of 2014

Patna High Court Cr.Misc. No.39123 of 2017 (3) dt.18-10-2017 2/2 stands restored to its original file and number.

5. The application stands disposed off.
