The petitioner apprehends his arrest in K. Nagar (Srinagar) P.S. Case No.468/16 for the offences under Sections 341, 323, 324, 325, 307, 447, 504/34 of the I.P.C. Admittedly, the incident occurred at spur of the moment and though the petitioner is alleged to have given a spade blow which hit the body and shoulder of the informant, the injuries so inflicted have been found to be simple in nature. The grievous injury so made and referred to in the injury report is not attributed to the petitioner. It is further submitted that there is case and counter case between the parties and the injuries have been inflicted on both sides.

No.35719 of 2017 (2) dt.16-08-2017 2/2 Considering the nature of allegation, history of dispute between the parties and the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M.-VI, Danapur, Patna, in K. Nagar( Sri Nagar) P.S. Case No.468/16 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
