JUSTICE PRABHAT KUMAR JHA ORAL ORDER 18-12-2015 Learned counsel for the petitioners seeks permission to withdraw the Anticipatory Bail Petition of petitioner no. 6, namely, Sohray Yadav.

Prayer is allowed.

The Anticipatory Bail Petition of petitioner no. 6, Sohray Yadav is dismissed as withdrawn.

Heard both sides.

The petitioners no. 1 to 5, namely, Ganga Yadav, Domu Yadav, Prit Yadav, Arbind Yadav and Mukesh Yadav apprehend their arrest in a case under Sections 323, 371, 307, 379, 504, 506/34 of the Indian Penal Code.

Patna High Court Cr.Misc. No.51727 of 2015 (2) dt.18-12-2015 2/2 All the petitioners are alleged to have assaulted the informant with stick and lathi but the informant Munna Yadav got two injuries. Both the injuries are simple in nature caused by hard and blunt object. There is a counter-version. Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in Manpur P.S. Case No. 73/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
