JUSTICE ARUN KUMAR ORAL ORDER 11-08-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 341, 323, 307, 354(B), 379, 34 of the Indian Penal Code.

Allegation in brief is that the accused persons due to the land dispute picked up quarrel and allegation is that the petitioner assaulted khanti blow on the head of the informant causing injury to her and when his brother came to her rescue, he was also assaulted.

Learned counsel for the petitioner submits that the petitioner and the informant are agnates. Due to land dispute, there is case and counter case between both sides. Alleged injury attributed to the petitioner is simple in nature and the petitioner

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Manish Kumar Chourasia be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Swati Singh, j.M. 1st Class, Katihar in connection with Manihari P.S. Case No.111 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
