JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 09-10-2018 Learned counsel for the petitioners submits that Court fee of Rs.350/- has already been submitted. So far as the, Defect No. 14(3) and 14(5) are concerned, the same be ignored. The present application has been filed for quashing of the order of proclamation dated 28.08.2018 issued by the Additional Chief Judicial Magistrate, VIIth Court, Patna in Kadamkuan P.S. Case No. 402 of 2018 issued under Section 82 of the Cr.P.C against the brother of he petitioners. Learned counsel submits that only because the brother of these petitioners is wanted in a criminal case, the properties of these petitioners cannot be subjected to attachment. It
Patna High Court Cr. WJC No.2533 of 2018 (2) dt.09-10-2018 2/2 is also pointed out that the father of these petitioners has also moved this Court in Cr.W.J.C. No. 2363 of 2018 which has been disposed off by this Court on 27.09.2018. This application may also be disposed off in the same terms.
Learned counsel for the State is present.
In the given facts and circumstances of the case, without going into the merit of the contentions, at this statge, the writ application is being disposed off in same terms as have been done in the case of Umesh Sharma vs. The State of Bihar and Ors in Cr.W.J.C. 2363 of 2018 passed vide order dated 27.09.2018.
