The petitioner seeks bail in connection with Laxmipur P.S. Case No.206 of 2014 registered under Sections 120(B) and 414 of the Indian Penal Code besides Sections 25(1-b)a, 26 and 35 of the Arms Act.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the police apprehended Murari Vishwakarma and one Lalu Kumar Yadav alias Rakesh Kumar and on search, they were found in possession of country made pistols and live cartridges etc. and they also disclosed that the petitioner being their associate was involved in
Patna High Court Cr.Misc. No.55402 of 2015 (3) dt.03-02-2016 2/2 the commission of the dacoity and there was also planning of loot. It is further submitted that as the petitioner is accused in several other cases that is the reason the name of the petitioner has been shown by the police in this case also. The petitioner, in the present case, is in custody since 19.09.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Jamui, in connection with Laxmipur P.S. Case No.206 of 2014. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
